Bmax Holding S.àr.l. (hereinafter « Bmax »), implements different processing on personal data collected on the site.

By using the bmax.com site, users also collect personal data of their members and are responsible for processing them. The contact details of the Users are available in their dedicated area.

Data collected

The personal data collected are as follows:

  • Data relating to the structure;
  • Data relating to members, according to the choice of fields by the User such as marital status, school history, legal officials, contacts in case of emergencies, sizes.
  • Bmax collects personal data relating to the legal representative of the User when creating his space by the latter.

Users collect personal data relating to members when using the bmax.com site; Users are free to choose the different data collection fields.

Purposes and legal bases of processing

The processing of personal data collected is for the following purposes:

  • Contract management, invoicing, accounting;
  • Sending information, events and commercial prospecting;
  • Compliance with legal obligations;
  • For security and business continuity purposes.
     

The legal bases for processing implemented are:

  • The performance of a contract (for example, providing the service requested);
  • Compliance with legal obligation (for example, retention of opposition applications);

Categories of recipients

The categories of recipients are persons authorized and acting within their powers:

In the context of their usual missions: personnel responsible for the award, management and execution of contracts, contractors, especially technical ones, subcontractors in the framework of their missions, persons involved in the contract such as lawyers, experts, judicial officers and ministerial officials;
As interested parties to the contract: the signatories, third parties interested in the performance of the contract.
As authorised persons in the name of authorised third parties: the courts concerned, arbitrators, mediators, ministries concerned, supervisory and control authorities and all public bodies entitled to receive them, the external and internal control departments.


Shelf life

These data are kept for the duration of the contractual relationship between the User and Bmax. Beyond that, the data is archived for the period of time when each party’s responsibility could be called into question before the data are permanently deleted.

The data are kept for the duration necessary to comply with the limitation periods as stipulated in articles 2224 and following of the Civil Code and the retention periods of accounting documents.

The data collected in connection with a request are kept for the time necessary to process the request.

Data collected in the context of commercial prospecting is kept until your consent is withdrawn or deleted in case of prolonged inactivity.
Cookies are kept for a maximum of 13 months.


Rights of persons

Any data subject has the following rights with regard to his or her data:

  • Right of access;
  • Right to rectification;
  • Right to erasure;
  • Right of opposition;
  • Right to withdraw consent at any time, without prejudice to the lawfulness of processing based on consent prior to withdrawal;
